Powerful voices.
Where would this move from here? Would there need to be an appeal or is it still in the courts? @BCKesso @MrTeeLew @HardAppleSnyder
I'm not sure how pardons are handled
Essentially, and I'm guessing, it doesn't get rid of the conviction.
Yes. Merely procedural
OMG! A masterpiece of constitutional law! This legal brief is on par with Marbury v. Madison. Almost cried reading its beauty!
Re the void pardon.
This is the argument I Tweeted two weeks ago: court should announce sentence for Arpaio to complete the exercise of Judicial Power.
@AndyGrewal @sbagen @rparloff @adamliptak : Even if pardon itself is valid, ought not invalidate the complete exercise of Indep. Jud. Power.
Even is sentence unenforceable, it serves valid and important constitutional purposes.
Thank you Rory. There are very few intelligent souls on Twitter.
Arguing is so über awesome!
If Chemerinsky says it it's true. That is just a law fact.
um, isn't a pardon an admission of guilt?
