There's a lot in here, and a lot of people are going to be making claims about what different parts of it mean or meant. Just be careful.

I'm not in any way discounting
@davidfolkenflik's reporting here. It's great. It's a caution as to things I saw in 5 minutes on Twitter. -
Yeah there's absolutely explosive and unverified stuff in the lawsuit that Folkenflik left out, kudos to him for that

Wait, wait: Ur takeaway from a well-sourced story w/ on-the-record confirmations, recorded messages & convos is "careful its just a filing?"
-
Literally the first two words I wrote are "Big story."
-
Then don't follow that statement up with three tweets qualifying the opposite. The article is 90% about things other than the lawsuit.
-
It's a "forest for the trees" argument. The lawsuit ref'd in the article is a sapling among adult Redwoods. Don't cut down the whole forest…
-
I didn't. This is an absurd characterization of a common-sense reality. Reality checks are necessary, however, these days— as shown by ...
-
... your and other people's responses. Three tweets about a common-sense caution really should not disturb you this much.

yes, well luckily a story has been written so we can read (or listen to) more than just the headline.

I understand. I would hope people would be level headed enough to not take anything at face value here.

That may be the most ridiculous statement I have ever heard a lawyer make. Good Grief. Are you seriously a member of a State Bar?
-
Oh, come off it. You're either a bad lawyer, or being intentionally dense. https://twitter.com/baylan295/status/892378967986122752 …

Which by definition means you cannot bring such a suit. Please.
-
Won't survive MTD (or "cannot bring") is not equal to complaint not being physically received by clerk and docketed. Duh.
-
And there are rules that EVERY lawyer must follow as officers of court to NOT bring frivolous/meritless suits. That's how to get disbarred
-
Of course. Enforcement of R11 and state analogs is a separate step though. One that not every firm/client will take. You CAN allege 1/2
-
2/2 anything in a complaint. Sanctions are a separate q from whether such a complaint will be received by clerk.
-
But it's not separate from a Lawyer's statement saying anyone can do such. What are you advocating? Flood the courts with frivolous suits?
