An Arkansas law says a married woman's husband will automatically be listed as the second parent. Not so for same-sex couples.
-
Even after Obergefell, Arkansas is seeking to uphold this law. Same-sex couples are challenging it, asking SCOTUS to review it.
-
Here's the
@SCOTUSblog page on the case; we've been waiting to hear from the court about what it is going to do:http://www.scotusblog.com/case-files/cases/pavan-v-smith/ … -
I would not be surprised if we get a summary reversal, striking down the differential treatment under Obergefell. We'll see.
-
Court would have to take the case first. That's what we are awaiting a decision on.
-
No, summary reversal comes from a cert petition.

@AGRutledge has a duty to defend AR law. State acknowledged in argument that legislature could fix by amending assisted reproduction statute -
