Asked whether Trump is invoking executive priv re: Comey conversations, WH's @SHSanders45 refers me to @marckasowitz, who has not responded.
Notably, it was @SHSanders45 who said earlier this week that Trump would not be invoking exec priv re: Comey conversations.
Maybe it's double secret executive privilege?
Most lawyers, emotionally, believe they could do any kind of legal thing with a night to read up. 1/2
Most lawyers, intellectually, know that's not true. When they don't... this happens. 2/2
I think I would have AT LEAST read @Tribelaw's feed. I can't get over the WH waiving privilege earlier this week and now trying to claim it.
To non-lawyers reading: Privilege, once waived, cannot be revived. The idea is logically nonsensical. And it is not hard to waive it.
Thank you for this! I was confused about whether or not you could flipflop on this.
Absolutely, positively not, although you can try to claim you didn't actually waive privilege. Which is very hard to do in most cases.
And would be utterly impossible with this one. The statement is out there.
Yep. Also, privilege doesn't generally apply against third parties disclosing what would be privileged info in a lawyer's hands.
"He's new at this"
Apparently a number of law firms turned Trump down as a client.
He's pretty much down to the ones that advertise for mesothelioma settlements on Fox and Friends.
Yeah.. Even Saul Goodman would have trouble representing him...
When he says he hires the "best people", he means the most loyal, not the most capable. Shows that in every post he's filled.
This is what happens when bad clients don't listen and don't pay. The good lawyers won't take your case. #NonRefundableRetainer
When a client won't follow your advice or lies to you, it can be an ethical nightmare for a lawyer.https://twitter.com/bungdan/status/865292444799193089 …
Incompetence beats malevolence once again
This guy seems like the legal equivalent of the Hobo Doc who proclaimed him the fittest man to ever hold office.
