Second and final decision of the day, also by Breyer, is Bank of America v. Miami. 11th Circuit decision is vacated and remanded.
Gorsuch did not participate in this Fair Housing Act case. Breyer is joined by Roberts, Ginsburg, Sotomayor, and Kagan.
Thomas, concurring in part and dissenting in part (mainly dissenting), is joined by Kennedy and Alito.
The decision — https://www.supremecourt.gov/opinions/16pdf/15-1111_5i36.pdf … — means that a city can sue under the FHA, but must show "proximate cause" for losses under the Act.
Thomas disagreed w/ the standing ruling, but concurred with the proximate cause standard (although he would have decided it, not remanded).
