I don't think we can say they judged it on the merits WITHOUT considering the nonsuit, but they certainly didn't say that's why they did it.

As I understand it, if ARSC had judged TRO on the merits, McKesson would be barred from bringing same suit under res judicata
Well, they vacated the TRO, which itself isn't a final judgment. It was a weird writ in the first place. The lawsuit itself was dismissed...
