Here's the filing:https://www.documentcloud.org/documents/3533027-IRAP-v-Trump-4th-Cir-En-Banc-Query-Plaintiffs.html#document/p4/a346421 …
DOJ had said yesterday, in response to the court's query, that it thought en banc was appropriate — if it didn't slow down the timeline.
As of now, oral arguments at the 4th Circuit are supposed to take place on May 8.
FYI: No notice of appeal filed yet in Hawaii (although it's not yet noon there).
Here's our @BuzzFeedNews story on last night's Hawaii ruling. (It's not clear @realDonaldTrump knows about it.) https://www.buzzfeed.com/mbvd/hawaii-judge-travel-ban-order?utm_term=.beyMqpKBJG#.uml42RgDOb …pic.twitter.com/XojjuxAiwp
And, DOJ filed a notice of appeal with the district court in Hawaii, as well as motions to stay Washington v. Trump and Ali v. Trump.
That mean Hawaii's case is going to the Ninth Circuit. Not clear yet how quickly DOJ will move, for a stay pending appeal or on the merits.
