DOJ had said yesterday, in response to the court's query, that it thought en banc was appropriate — if it didn't slow down the timeline.
-
As of now, oral arguments at the 4th Circuit are supposed to take place on May 8.
-
FYI: No notice of appeal filed yet in Hawaii (although it's not yet noon there).
-
Here's our
@BuzzFeedNews story on last night's Hawaii ruling. (It's not clear@realDonaldTrump knows about it.) https://www.buzzfeed.com/mbvd/hawaii-judge-travel-ban-order?utm_term=.beyMqpKBJG#.uml42RgDOb …pic.twitter.com/XojjuxAiwp

And, DOJ filed a notice of appeal with the district court in Hawaii, as well as motions to stay Washington v. Trump and Ali v. Trump.
-
That mean Hawaii's case is going to the Ninth Circuit. Not clear yet how quickly DOJ will move, for a stay pending appeal or on the merits.

I guess given speedy Gorsuch timeline they figured slow-walking it wouldn't make any difference.

Looked it up. I guess if all judges are to hear case. It's better than just a few hearing it. Consensus means thinking & talking it out.
