Nine of the 15 judges on the 4th Circuit were nominated by Dem presidents; five by GOP; one — the current chief judge — by both.
The current chief judge, Roger Gregory, was initially nominated by Clinton in the last year of his presidency.
When he wasn't confirmed, Clinton gave him a recess app't. Later, George W. Bush renominated Gregory, the 1st black judge on the 4th Cir.
He was confirmed 93-1. Trent Lott voted against Gregory — citing Clinton's use of the recess appointment power.
For a long time, the 4th Circuit was a safely conservative—one of the most conservative circuits. Obama, with 7 appointments, changed that.
In sum, hard to see this as anything but a good sign for challengers to the EO — if it goes en banc, no chance of a bad panel draw for them.
I wonder how decimated this summer's tourist season will be.

It's about time people stood up against the biased courts and their agenda. They cannot rule against the Constitution.
And ironically, these 13 states are always the bottom 13 in Education, Health, Quality of Life, Violence Against Women, etc...
