Suspect that will be the ruling, unless CA9 buys there should be no judicial scrutiny in immigration/nat sec.

But then we're just waiting 10-20 days for a PI ruling from the disctrict court.

Yep; but, I suspect punting on appealability is the only way the TRO stays in place...

Can't see CA9 ruling to affirm on the merits of the TRO. If they reach the merits at this stage...
