I'm headed up to the courtroom for arguments in Bethune-Hill v. Virginia Bd of Elections and McCrory (NC) v. Harris. #SCOTUS
First take out of #SCOTUS args: Breyer really liked his 2014 opinion in Alabama Legislative Black Caucus v. Alabama. https://www.supremecourt.gov/opinions/14pdf/13-895_o7jq.pdf …
Also: It is entirely possible that Breyer made a subtle #Hamilton reference in today's args, mentioning, "times change, oceans rise, etc."
Substantively, tho, it is clear this is all somewhat of a jumble. The justices spent 2 hours discussing ins & outs of 2 states' legis maps.
There is no doubt of the importance of the matter, but significant time was spent debating the credibility of trial court witness testimony.
I can't imagine a world in which it makes sense to presume the justices are the best positioned to be having such fact-bound debates.
