ALABAMA, YOU CAN'T MAKE ANYTHING SIMPLE, CAN YOU?
Clarification: I should've said "effectively removed." I am now neck-deep in the Alabama implications of "suspended for term" v. "removed."
Moore is not eligible to run again for another term due to his age, so, he is, effectively, removed from the office of Chief Justice.
Mat Staver and I agree on that point!
BUT! The suspension for term creates two questions that I have found distinct from removal from office: (1) Does this mean Moore remains ...
... eligible after leaving office to sit as a supernumerary justice (filling in)? (2) Does this mean there is not a vacancy in office ...
... meaning no chance for the governor to appoint someone?
Additionally, and politically, how does this play in to talk of Moore running for governor?
My understanding:
1. Yes.
2. Yes.
3. Who knows? (More on 3 coming in @lyman_brian RTs)
