We're waiting on #SCOTUS news on the stay Michigan Sec of State application in this thread:https://twitter.com/chrisgeidner/status/771769849894801408 …
I'm home. Still no news from #SCOTUS on the Michigan Sec of State's stay request in the straight-ticket voting case.
I think @rickhasen is right here — http://electionlawblog.org/?p=86369 — so far as it goes, but the technical question I'm wondering is whether ...
... this becomes constructive denial of the stay at midnight, if no #SCOTUS action, or whether a stay b4 offices open in Mich on Fri is OK.
Reminder: Very few things are clear at #SCOTUS, outside of the end result of a request or case.
I think the key point @rickhasen makes: "[I]f the Court was going to grant relief, it knew it had to do so by the end of Sept. 8."
While we don't *know* what's going on at #SCOTUS, I think Rick's right that we'd likely get a ruling by midnight if they granted the stay.
(Since that's what the Michigan Sec of State told the Court she needed.)
Well, it's Sept. 9. The Michigan Secretary of State said she needed a stay by Sept. 8. #SCOTUS has not granted a stay.
If #SCOTUS does not act, or eventually denies the request, that means straight-ticket voting will remain in Michigan for this election.
It's still possible ~something~ could happen overnight, though, so don't count your chickens just yet, Michiganders.
Still no action from #SCOTUS on Mich. Sec. of State's stay request, so it would appear that straight-ticket voting will be allowed this Nov.
