UPDATE: There was a SECOND cert petition filed in John Conner's Georgia case, out of the 11th Cir:pic.twitter.com/605zm7ZgAH
Georgia, unsurprisingly, also opposed this request, reframing the questions presented as:pic.twitter.com/kbUQ8wYwXN
Apologies for the confusion tonight. I had not realized there was a case pending at the 11th Circuit when the initial SCOTUS ruling came.
Usually, SCOTUS holds all petitions in a case if they expect multiple so that they can consider them/issue decisions together.
I have to imagine the court was wondering what was going on here if they issued the ruling out of GA before getting petition out of 11th.
#SCOTUS can rule when it wants, however, and it chose to rule on the one petition before receiving the second.https://www.buzzfeed.com/chrismcdaniel/georgia-scheduled-to-end-nations-two-month-death-penalty-hia?utm_term=.ydW1wEVKNe#.vj0x7OPJZL …
Read the petitions and Georgia's responses in the @BuzzFeedNews story on the scheduled execution of John Conner:https://www.buzzfeed.com/chrismcdaniel/georgia-scheduled-to-end-nations-two-month-death-penalty-hia?utm_term=.ydW1wEVKNe#.vj0x7OPJZL …
Given his concurrence in Ayala last year, one wonders if this is an issue Kennedy might throw in for.
Not exactly the same issue (long term solitary vs. long term death row occupancy) but certainly closely related.
Has SCOTUS yet considered the California delay case that Judge Carney ruled on a while back?
