#SCOTUS had granted a case raising this question—but turned out that question was NOT granted by the court. -
We see tonight that Breyer, apparently, remains alone — at least in being willing to speak out on his view on this issue.

Apologies for the confusion tonight. I had not realized there was a case pending at the 11th Circuit when the initial SCOTUS ruling came.

Usually, SCOTUS holds all petitions in a case if they expect multiple so that they can consider them/issue decisions together.

I have to imagine the court was wondering what was going on here if they issued the ruling out of GA before getting petition out of 11th.

So, despite some hope from some capital defense attorneys, the justices do not appear to have treated the two petitions differently.

I am still awaiting word from Georgia, where there is nothing standing in the way of them proceeding with the execution of John Conner.
