Breyer (1st), Sotomayor (2nd), Alito (3rd), and Kennedy (9th). Only Kagan didn't come from a fed appeals ct; She came from the SG's Office.

Both of Obama's prior vacancies came from justices who had been fed appeals ct judges before SCOTUS: Souter (1st) and Stevens (7th).

Perhaps but doubtful, I think. Fed app ct is the best prep for the SCT, and that's where the best candidates tend to go

i think that's partially true, but having been through confirmation process previously is important now, i'd say.
