So, for people who are still ~slow~ to understanding what's going on with LGBT protections at the federal level, here's some help.

On the trans issue, specifically, many courts have been on board: Here's the 11th Circuit: https://scholar.google.com/scholar_case?case=16555670383261317325&hl=en&as_sdt=6&as_vis=1&oi=scholarr …pic.twitter.com/m4jnU2xmGO

NOTE: These rulings primarily come out of two
#SCOTUS decisions: Price Waterhouse and Oncale. SCALIA wrote Oncale:pic.twitter.com/EZ7Tw9jMyN

Here's the full Oncale decision, about coverage of same-sex sexual harassment:http://caselaw.findlaw.com/us-supreme-court/523/75.html …

LGBT advocates shied away from acknowledging EEOC's work bc it was off-message of their lobbying for explicit LGBT employment protections.
-
Eventually, when Congress changed hands — and when the EEOC's work was leading to tangible results — LGBT groups started acknowledging it.
-
Just because something is complicated, however, is no excuse for a JOURNALIST or COMMENTATOR to pretend it doesn't exist.
-
The EEOC says existing civil rights law covers LGBT people. Some courts and the Obama admin have backed parts of the interp already.
-
Those are facts. If you think that's problematic, talk to the ghosts of Justices Brennan & Scalia — or to EEOC Commissioner
