Note: There's a lot in here that's ~NOT~ going to stand up on appeal. It's clear Judge Todd has a LOT of dissatisfaction with the system ...
-
... and she was not going to let this ruling out the door without getting all of the issues out in the open. See:pic.twitter.com/l7Xbzt8GPm

That's point 7 in a section full of findings about AL's system, about which Todd concludes:pic.twitter.com/Ouc4quHpJe
-
HOWEVER, the ~key~ finding here is that Hurst v. FL applies to AL, and that, as such, its death sentencing scheme is unconstitutional.
-
And THAT is a ruling likely to stand up to scrutiny (if not on appeal within the AL courts). Read my report here: http://www.buzzfeed.com/chrisgeidner/alabama-death-penalty-law-is-unconstitutional-state-judge-ru#.mndobXJ40d …

@chrisgeidner@BuzzFeedNews Interesting opinion, in line with recent Florida case. Does not say death penalty unconst. Just that application -
@toodeemo@BuzzFeedNews She rules that the death sentencing law is unconstitutional. -
@chrisgeidner@BuzzFeedNews Exactly. But not the death penalty in and of itself. There is a difference. -
@chrisgeidner Just pointing out that the death penalty can be reinstated. That's all. Not to those already sentenced probably. -
@toodeemo I'm well aware of that. And, the ruling is almost certainly going to be appealed immediately. -
@toodeemo But the fact is that the death sentencing law is what creates the death penalty. Without it, there is no death penalty. -
@toodeemo See, e.g., Florida. - 1 more reply
