Second, the editorial is wrong - although the author(s) are not at fault for not knowing - about Shonda Walter's cert petition out of PA.

As the SCOTUS docket was updated at some point since Fri afternoon to reflect, Walter's petition was rescheduled ...pic.twitter.com/QK4ZIvSP4c

... meaning the justices did not consider the cert petition at Friday's conference.

Additionally, the NYT is not technically accurate when it says "Shonda Walter's case is the first to take up Justice Breyer's challenge."

I'm not at my computer now, but at least 1 (& I think several) last-minute cert petition(s)/stay application(s) raised full 8th Am question.

Walter is the first one not brought w execution pending, yes, but the issue has been before the justices since Breyer's Glossip dissent.
