Seriously, tho, another big opinion out of the DC Circuit today, upholding the protest/rally ban on #SCOTUS plaza: http://www.cadc.uscourts.gov/internet/opinions.nsf/D8B3547AD4B7D85685257EAF004F71BC/$file/13-5250-1570216.pdf …
DC Circuit's rationale — that the policy is viewpoint-neutral — is undercut by the facts of June 26, 2015.pic.twitter.com/DmvHHBfdy1
On that day, when Obergefell was handed down, the court allowed a "demonstrations applauding the Court's actions."
So, the #SCOTUS plaza policy is not enforced — at least not at all times — in a viewpoint-neutral way.
@chrisgeidner Did the Court allow the assembly because it was favorable, or because stopping it would be nearly impossible? I think latter.
@smmarotta Honestly, I thought it was less of a shitshow outside the court this year than in 2013 for Windsor/Perry.
@smmarotta When I walked out of the court and saw all the people on the plaza, it actually was the most surprising part of the entire day.
@chrisgeidner @smmarotta same. recall, in my shock, telling bystanders to take in a scene they're not likely to witness again
