Has anybody heard a legal theory for why DACA is lawful but DAPA and expanded DACA are unlawful?
@conncarroll @sahilkapur Of course. Sahil wasn't asking a question of Hanen. He was asking a more general question: What's the distinction?

@conncarroll@sahilkapur Why are these impermissible, but that is OK? Or, is DACA not OK but just not challenged here? -
@chrisgeidner@conncarroll correct, that’s exactly what I’m wondering. -
@sahilkapur@chrisgeidner before DAPA was even announced I said there was none. -
@conncarroll@chrisgeidner Be interesting to see if the plaintiffs agree. The question of where to draw the line will inevitably come up. -
@sahilkapur@chrisgeidner no. see this was my original point. plaintiffs already drew the line by not including DACA in their complaint. -
@conncarroll@chrisgeidner did they give a reason? -
@sahilkapur@chrisgeidner 1) they don't need to; 2) no; 3) DAPA is a much bigger program
