@BenWinslow @chrisjohnson82 Yes, en banc is a longshot & I don't imagine any lawyer will ultimately advise it. But, they're still deciding.
@chrisgeidner @BenWinslow Would there any advantage to en banc other than delaying a decision from #SCOTUS?
@chrisjohnson82 @BenWinslow If you thought you could get a win. You always would, ideally, want to arrive at SCOTUS on the winning side.
@chrisgeidner @BenWinslow Why would SCOTUS care what the full 10th Circuit decides? SCOTUS is the high court and can do what it wants.
@chrisjohnson82 @BenWinslow … one, you'd be more likely to go for that than getting to the court off two losses.
@chrisgeidner @BenWinslow You haven't explained why it would influence SCOTUS. Won't it look to Windsor for precedent, not 10th Circuit?
@chrisjohnson82 @BenWinslow Yes, it does whatever it wants. But, going UP TO the court, you want it to be on as good of terms as possible.
@chrisgeidner @chrisjohnson82 Which is what I've been reporting all morning long. :)
