      Justice Kavanaugh did not participate. Also, as I've noted before, justices do not need to state their votes in applications like this. As such, all that we know is that a majority voted against vacating the stay, and that 2 of the 8 justices participating noted their dissent.

      Correction, via @ssamcham: The ND SCOTUS application (see the thread that this is a reply to) only needed to be a 4-4, not majority, vote for the voter ID requirement to be enforced for this election b/c a tie vote would mean the 8th Cir decision, staying the injunction, stands.

          It means either or both of them could have voted either way. We don’t know. And won’t, likely, unless it comes out in later developments in the case if it gets to the court on the merits and the stay vote is still relevant (which is unlikely, I’d think).

          I spent all of last Saturday night reading the SCOTUS rulings regarding civil rights since the Civil War. With a couple small exceptions, SCOTUS rulings have always ruled against Native Americans. To the point you could say it was weaponized to inflict maximum damage to them.

          Not necessarily, but it is the most likely scenario. The second most likely is they disagreed with the “majority” but couldnt articulate why.
