Here was North Dakota's opposition to the request. (The state hired William Consovoy in DC as outside counsel.) —> https://www.supremecourt.gov/DocketPDF/18/18A335/65538/20181002165418306_Opposition%20to%20Motion%20to%20Vacate.pdf …pic.twitter.com/PIFvsDo1W8

In today's order, Justice Ginsburg, joined by Justice Kagan, dissented, noting that the "risk of voter confusion appears severe here" because different rules applied during the primary election.https://www.documentcloud.org/documents/4999244-18A335-Brakebill-v-Jaeger-Order.html …

Justice Kavanaugh did not participate. Also, as I've noted before, justices do not need to state their votes in applications like this. As such, all that we know is that a majority voted against vacating the stay, and that 2 of the 8 justices participating noted their dissent.

Those seeking to have the requirement — that a voter's ID have their "current residential street address" — enjoined say it discriminates against Native Americans in North Dakota. (The district court agreed.)pic.twitter.com/jbvDolZeBJ

Correction, via @ssamcham: The ND SCOTUS application (see the thread that this is a reply to) only needed to be a 4-4, not majority, vote for the voter ID requirement to be enforced for this election b/c a tie vote would mean the 8th Cir decision, staying the injunction, stands.

Of course the law would discriminate. Who is a citizen and who isn't That is the only discrimination that is allowed on this country.

Yeah, I’m gonna have a real problem addressing him as Justice, but I’m already calling trump “it.” “Rapist” will work in a pinch, though, only if both aren’t mentioned in the same sentence. That’d could get confusing!
