You certainly can respect someone’s desire for an embargo, but if they sent you the information before you agreed to an embargo, you’re agreeing to the embargo is totally voluntary.

really? i've always been led to believe opening an email that is labeled as embargoed is agreeing to the embargo.

There is nothing formal or legal about embargoes of off-the-record. It’s not like terms of service or something. It’s a voluntary agreement. If they send you something without reaching an agreement first, they’ve just sent it to you hoping you’ll respect the agreement.

Of course, you can have preexisting relationships with people such that it’s understood that you will accept and adhere to such embargoes. But that’s different from unsolicited pitches.

idk this feels weird. it seems to infer that there is not an understanding in the industry at large that journalists should adhere to embargoes. but to each their own.

If in the initial contact they say it’s “embargoed,” then yes it is. Similar to you talking to someone & saying it’s off the record. Reminder to media, don’t be assholes just because you think you can.

That’s not how an embargo works. If you send me information, I can do what I want with it. Agreeing to an embargo, like agreeing to be off-the-record, is not something that one party can just declare.

Now you’re just telling your self lies. Agree both parties need to agree, but if one person says this is off the record or embargoed, proceeds to tell you something before you say you disagree, it should be held.

I think same rules in law enforcement. If a suspect says "Ok, you guys can't use this against me but I killed that guy." I don't think law enforcement is going to feel bound by that. But if they make an agreement to not use his statement - then that's different.
