Recall that every judge to consider the propriety of Mueller's appointment and authority has sided with Mueller, including Judge Ellis in Virginia — who questioned Mueller's team sharply in court.

But Andrew Miller's D.C. Cir. brief is due tonight, whenever his counsel sorts out his <ahem> "serious problems with his version of Word." So sixth time could be the charm.

Per the DC Circuit's automated system, Miller's lawyer was about a minute and a half late. (Won't likely make a difference for Miller, technically, but the court knows and his lawyer has certainly not made a good showing these past few days.)pic.twitter.com/czakTq2k9h

He can date the brief anything he wants. The date-stamp on ECF says 9/12. I've had to file an extension motion in that situation, asking for a 2 minute extension of the deadline.

They very likely will be able to file a corrected version that cleans all this up, so that the copy ultimately given to the judges will not be a mess. But in a case like this, especially with the wacky extension motion from yesterday, I bet they’ll know the warted history.
