        If Justice Thomas doesn't know where 'reasonable expectation of privacy' comes from, he doesn't deserve his seat. I've had one Con Law class, and I can nail that question.

        Gorsuch might be with him. We'll see on Kavanaugh. Essentially the idea that precedents matter (and can build on each other) is the "common law constitution." Some hard-core originalists reject it.

        It seems pretty similar to his stock privileges & immunities clause argument which results in the same circular "what are the privileges and immunities of US citizens?" you get from the SDP/privacy/dignity/decency arguments.
