      Miller, for those who haven't been following along at home, is the Roger Stone associate who the special counsel's office has been trying to get to testify before the grand jury. He's refused and was held in contempt. He appealed.

      He argued — similar to Manafort — that Mueller lacks authority to call him before the grand jury, challenging his appointment. The district court judge ruled against him, setting up the contempt order.

      At the same time, in the Russian troll farm case, Concord Management and Consulting — the defendant who has responded to the charges — also challenged Mueller's authority and also lost at the district court. They moved last week to intervene in Miller's appeal.

          Psst. Respectfully, the filing of a notice of appeal of an interlocutory order does not create appellate jurisdiction with respect to such appeal. Jurisdiction in federal courts is primarily created by statute. But thanks for your misdirected snark.

          Oh, well, your tweet wasn't clear, and I was just saying, "There is an order in there," because I thought you just saw the "opinion" mentioned in the Notice of Appeal. / And I wasn't responding to the jurisdiction question, as I think that fight will be ongoing.
