      Based on our shared experience here, I have to imagine that thousands of people violate this law every day on Twitter. (There are some days that I feel like I see dozens.)       It’s not a defense. If the facts are as alleged, he would appear to be guilty of the crime. My question is how are enforcement decisions made regarding a law that a half-million people have probably violated on Twitter.

      That's a question relevant to much of law enforcement in or out of Twitter. Maybe enforcing IRL law on Twitter is the only good TOS for social media.

      Yes, and many good questions have been raised about prosecutorial discretion outside of Twitter. This appeared to be a key instance where one would raise that question here, given, for example, the well-documented threats women often face on Twitter.
