These records are coming from the George W. Bush Presidential Library, with "consultation" with the National Archives, and Bush authorized the public release, per Grassley.

It is possible, however, that they could have chosen to withhold items that the National Archives, in its review, believes should not be withheld. NARA's counsel said it'll take them until late October even to review the records, though.

The FOIA response is a third route — beyond the GWB Library and the National Archives — for trying to get Kavanaugh's documents. Senate Dems also took that route this week after being denied by the National Archives.
