      So, this is a bit confused! States can and do regulate abortion — with limits — currently.       Overturning Roe, though, would free states "to determine their own laws regulating abortion" even further, and without the protections for access to abortion. So, I'm not sure what Man-Of-Many-Trumps T-shirt actually wants — and I'm not sure he knows.

          To be even more specific, Roe v. Wade wouldn't likely be overturned anyway. It has, effectively, been amended by Casey, the 1992 case that declared that "the essential holding of Roe v. Wade should be retained and once again reaffirmed." The "essential holding" was reaffirmed ...

          ... but the "undue burden" standard of Casey that was reaffirmed in Whole Women's Health is the standard governing state laws currently. Altering or watering down that standard likely would be the path anti-abortion groups would pursue.

          I mean, if they overturned something being a fundamental right ... it would no longer be a fundamental right. But, as to my wording, I was using it in reference to his tweet and understanding his logic specifically.
