          I mean, this is the guy who wrote, “Times can blind us ...” so, I think that horse is long out of the barn. (That said, I don’t think, “We got it wrong before and technological changes have made that all the more clear” is necessarily a rebuke of originalism.)

          I don't like the result (taxation) but I went through law school and I know the Constitution, the Commerce Clause, and the fact that the loss of brick and mortar stores has compelled shopping to move online (across state lines), thus Kennedy's reasoning is sound. 1/

          2/ The Constitution is a living document precisely because times change. Technology has changed the way commerce takes place. States provide infrastructure through taxation. This is the correct result.
