In Monday's orders, the court took no action on Arlene's Flowers — a case out of Washington similar to Masterpiece Cakeshop. #SCOTUS
The court GVR'ed (grant, vacate, and remand) a handful of cases out of the 4th, 5th, and 6th circuits in light of Hughes v. US — a sentencing case decided by the court last week in favor of the criminal defendant. #SCOTUS
Here's the full orders list: https://www.supremecourt.gov/orders/courtorders/061118zor_aplc.pdf … #SCOTUS
Among the cases remaining for decisions are Trump's travel ban, partisan and racial gerrymandering cases, cell phone records, public sector union fees, Ohio's voter purge rules, and California's crisis pregnancy center disclosure law, sales taxes, and ALJs. #SCOTUS
First decision is in Sveen v. Melin. Kagan writes the decision for the court, reversing the 8th Circuit. Only Gorsuch dissents.
In Husted v. A. Philip Randolph Institute, the Supreme Court, in a 5-4 decision, upholds Ohio's process for removing voters from the rolls.
Justice Alito writes for the 5-4 court. Thomas concurs. Breyer dissents for the four more liberal justices. Sotomayor also writes alone.
Here is the court's opinion: https://www.supremecourt.gov/opinions/17pdf/16-980_f2q3.pdf … #SCOTUS
Here was my report from the argument, where this outcome appeared likely: https://www.buzzfeed.com/chrisgeidner/justices-appear-likely-to-uphold-ohios-system-for-removing?utm_term=.yx07g0GYa#.wixylB8OV … #SCOTUS
Next is China Agritech v. Resh. Ginsburg writes the decision, reversing the 9th Circuit. There were no dissents, but Sotomayor concurred only in judgment.
Here's the China Agritech decision: https://www.supremecourt.gov/opinions/17pdf/17-432_08m1.pdf … #SCOTUS
We are awaiting (likely) one more decision, but RBG is still reading from China Agritech.
Final decision is Washington v. US. Judgment is affirmed by an equally divided court. There is no opinion — or national precedent. Kennedy did not participate. #SCOTUS
JUST IN: #SCOTUS will be sitting again Thursday. As in, more opinions expected still this week — on Thursday — from among the 21 remaining cases.
My breaking report —> #SCOTUS Just Upheld Ohio's Aggressive Process For Purging Voters From The Rollshttps://www.buzzfeed.com/chrisgeidner/the-supreme-court-just-upheld-ohios-aggressive-process-for?utm_term=.usy0GMxYm …
In terms of the added day, it's not very surprising. The court begins adding days to the schedule as we approach mid-June every year. Without added days, there would only be two more days (June 18 and 25) to release the 21 remaining decisions. #SCOTUS
Paul Smith, who argued the Ohio voter purge case on behalf of the challengers to Ohio's law, says Monday's #SCOTUS ruling is "a setback for voting rights nationwide." Ohio Sec. of State Jon Husted, however, criticized the challenge — and urged other states to take up Ohio's system. https://www.buzzfeed.com/chrisgeidner/the-supreme-court-just-upheld-ohios-aggressive-process-for?utm_term=.rm4rLeylX#.xrzQr0JZe …pic.twitter.com/ew5YzkTVdv
