Update: Michael Cohen's lawyer has filed a notice that he is removing Stormy Daniels' new lawsuit to federal court. (This means it likely will be heard in federal court, instead of Calif. state court, where it was filed.)https://www.documentcloud.org/documents/4498013-Clifford-v-Davidson-Cohen-Notice-of-Removal.html …

You can't remove based on diversity if any of the defendants is a citizen of the forum state (here, Davidson is alleged to be a citizen of CA). This will be remanded pronto.

Hmmm. Looks like they're basing it on the fact that Davidson hasn't been served yet?

Well, I guess if Davidson never gets served that would work, but seems unlikely.

CD of CA: “blindly applying” the rule would improperly allow defendants to “effectively always prevent imposition of the [resident defendant rule] by monitoring state dockets and removing an action prior to service.” Standing v. Watson Pharm., Inc. (Mar. 26, 2009).
