AI regulations would likely apply to particular areas of high-stakes decisions (mortgages, insurance, jobs). So, this is plausibly a problem, but certainly not for like, clothing recommender systems.

Also, currently, good-actors who are doing the work anyway are disadvantaged, compared to lazy/bad actors - some of whom won't even examine their models for bias and other problems, since then they'd have known there was bias if they get sued. They are incentivized to do nothing.

Ideally, organisations would incorporate AI ethics considerations into their existing ethics and company culture practices. Since most businesses don't actively consider ethics or have a framework in place, enforcing via regulation might be the only option.

I don't think increased care and esp. regulation around public sector / government uses of AI lead to a monopoly of the techniques for big companies, in much the same way other regulatory frameworks have not stopped small businesses either.
