My colleague and I wrote last week about Biden administration national security legal and policy officials wrestling with whether to do so - complicated by the Biden White House's desire to take no part in making such a decision.

Two House Dems who are former prosecutors have written to DOJ's inspector general requesting he investigate the things & I reported in our story on the Durham inquiry. Durbin says Senate Judiciary Cmte will also look into it.

From time to time, journalists have to re-learn that it is a mistake to engage with, rather than ignore, bad-faith actors; they use it for more fodder. Jenkins says he will write about our exchange. Rather than let him misrepresent things, I’m going to post its entirety here./3

Besides the unnecessary personal attacks, Jenkins claimed I had written something last August that I did not remember writing and could not find in the archives. So I wrote to him requesting a correction./2

Bob Bauer issues another statement saying the FBI search of Biden's beach house is complete and found no docs with classified markings, but agents did take "some materials and handwritten notes that appear to relate to his time as vice president" for further review.

A plea deal proposed last year by prosecutors in the 9/11 case is presenting a dilemma for senior national security lawyers in the Biden administration: The White House is avoiding the issue. So are they the proper people to bless it? w

The attempt to hold a 9/11 trial before the Gitmo military tribunals is not working. But GOP lawmakers wouldn't let Bill Barr move it to civilian court. Now Biden officials are weighing a plea deal to avert the need for a trial--giving up on executing KSM.

Also: Using military tribunals after 9/11 was Bill Barr's brainchild -- he called the Bush WH and suggested it. In 2019-20, as AG, Barr recognized the system was "a hopeless mess" & made a quiet push to bring the 9/11 case to civilian court, but top GOP lawmakers quashed it.
