I'm honestly curious....is it necessarily badmouthing if they were in fact fired due to "underperforming"? i mean, it's a general norm not to disclose the reason behind layoffs but there's something here i'm just not grokking

It's a norms violation *and* a meta-norms violation. Norms violation: Publicly criticizing someone who was let go. Meta-norms violation: This guy violated a well-known norm that everyone knows is well-known, and he hasn't explained why his norm calibration was off. Bad tingles.

i mean, there's also a thing here where "layoff" is supposed to mean the employee was terminated for financial reasons of the company not for poor performance, which has serious implications around unemployment insurance
