It is not the free market. YouTube receives immunity from liability for user posts via a special government carveout called the Safe Harbor provision of the Communications Decency Act section 230. They must act as a neutral public forum to benefit. Otherwise they are a publisher.

Actually that IS the problem. They are getting to have their cake and eat it too. They have to lose the protection for you to sue them. They have millions of dollars and a team of lobbyists. Good luck doing that.

But that was what big tobacco was doing also. These tech giants are just MySpaces of the future. In next 5 years at least one of them bites the dust.
