As written, that is what SCOTUS will decide when birthright citizenship hits the court. Read the 14 amendment again. Only applies to those under jurisdiction of the United States government. Illegal immigrants are not.

Not under our jurisdiction? Good grief... You might want to tell all the illegal immigrants we have convicted through due process. MT
@JerryChilds -
Apples and oranges, but thanks for playing.
-
“All persons born...” All of the sudden, the constitution is a living document?
-
Yep. The Left will this time correctly argue that the Constitution means what it says. The Right will argue that dead white men wrote that 150 years ago and times have changed. “Under US jurisdiction” covers those born in territories, military bases, embassies, etc.

"AND subject to the jurisdiction thereof." Illegal immigrants are not citizens.
-
Right, but people born here are not illegal immigrants. The clause you quoted refers to people who are born here. Seriously, this is a settled legal issue. It has been for quite some time.
-
It's not settled law. The intent is clear. Its being abused. It was never meant for illegal aliens. Killing this will hugely disincentive illegal immigration
-
No law is ever set in stone. SCOTUS upheld both slavery and separate but equal.

Ok so if
@POTUS can just EO Birthright citizenship what's not to stop the next president to do the same with the 2nd amendment the 1st and so forth. Come Mr. President don't be so ignorant as to how the Constitution works. -
No. It doesn't work like that. The 2nd is clear. 14th has never been to scotus and was meant for slaves not illegals
-
See you at SCOTUS

We also should amend the Constitution to end birthright citizenship. It is beyond absurd to reward people for having children while they are here violating our sovereignty.
-
Zip it.
-
Nah. We'll continue talking and it's going to SCOTUS, they will decide what's constitutional or not
-
It is not inconceivable that the court would decide Congress can determine the scope of the term "jurisdiction" in the birthright clause. I doubt executive order will be sufficient, however.

IMMIGRATION REFORM IS CODE FOR AMNESTY. We dont need reform. We need to enforce the law as written. Cut the loopholes.
-
Just like we went from they aren’t getting in to building tent cities that provide healthcare, food, water and possible processing to enter...
-
Yep just like that Their claims of asylum will be processed and the vast majority will be denied and ultimately they "aren't getting in" There will be no invasion no humanitarian crisis Just a
#StableGenius slipping the jab and landing the right hook. (Again)#KeepTrying -
