  7. The internet is what it is not because it's changing too fast or is too nebulous to regulate. It's because of conscious, deliberate decisions NOT to regulate it. It's because lobbyists (like the ) are paid by tech companies to shut down efforts to regulate. 3/

  8. And the CDA granting immunity to tech companies for third party content passed in 1996. Both were well before the modern internet. Laws can actually be very nimble and responsive. In about four years, we went from 3 states with nonconsensual porn criminal laws, to 46 states. 2/

  9. I can't count how often I get asked if law just can't keep up with tech. Or hear somebody liken the internet to the wild wild west. Actually, law CAN keep up with tech. We've had hacking crim laws (CFAA) since the 1986 Regan hysteria over the teen movie, War Games. 1/

  11. A good reminder that we need to name insurance companies that are doing bad. If they lobby against our NY proposed legislation opening up the adult sexual abuse SOL, we will name names and sue harder when our bill passes. ⚖️💣💥

    Also, I know many have pushed back on it, but this is a powerful example of the idea of "clickbait defamation" that raises. Headlines, memes, pictures are stand alone objects. Even reading that entire CNBC article you wouldn't *really* be clear about what the story was.

  17. be slow AF and never share evidence with victims. By the time they open a case and subpoena, evidence is gone. And sometimes victims don't want law enforcement -- they want to use the civil system. 14/12

  18. A response from to a standard litigation preservation letter. FB indicates that they aren't allowed to preserve evidence unless a request comes from the government. This is a lie. They tell me to contact law enforcement. Dude, law enforcement can 13/12
