Legal against whom? How do you identify an anonymous individual on the Internet? How do you enforce a cease and desist against someone stealing your technology and brand to steal money from people you wish to protect? In that case, it is best to have a "Lysine Contingency"

It doesn't matter which person it is against, it doesn't make hacking back legal or ethical, and it doesn't mean that the same issues couldn't be exploited against IOTA.

It's not "hacking back", it is disabling a fraudulent copy set up to steal money. It can't be done to IOTA because the full source code is not vulnerable to this attack. There is nothing illegal or unethical about this.
