      The difference is that software can be fixed for free (and open source software typically doesn't cost money), while CPUs can't and do. There's a reason e.g. Europe requires a 2-year warranty on everything.

      I think normal warranty rules should apply. That is, for CPUs purchased within a reasonable period, Intel should offer returns or exchanges with a partial refund or upgrade to a better model for the expected performance loss. They gambled on the speculation and lost.

      That's also a reasonable stance. But in the same breath, one can't expect hardware vendors to share detailed docs, because every time a new bug is found they'd have a wave of returns/refunds. No incentive for transparency: better to delay disclosure until the warranty expires.

      That is true, but that is also why we have product liability laws. It should not be legal for Intel to withhold information about a known design defect, especially if it has security implications. Ultimately, there is no inherent incentive to disclose anyway; bugs = bad PR.

      I also don't think Intel should have witheld information. Disclosure is good. But disclose-and-pay-up also means any open silicon startup would go out of business doing refunds over bugs discovered in their very first product! It's not just bad PR, it's about not making payroll.

          There's a delicate balance to be struck on what requires a recall and how much liability is appropriate, certainly. That said, more testing and more chicken bits :-)

          True that. Until that balance becomes codified, I don't see myself launching an open SoC project. It's otherwise impossible to manage risk, and I don't relish the idea of laying off a team of good engineers as we'd almost certainly miss one sidechannel in a billion transistors.
