In terms of what can be done before.. More aggressive Defensive publication?
Yes we try to publish as much as we can! Unfortunately it seems that actual patent applications are still far stronger as prior art, which is not affordable for us. Examiners still seem to mostly look only to prior patents + submitted applications for prior art searches
That's messed up... that means a major journal publication also doesn't help much from a patent application standpoint, right?
