Does anyone have experience dealing with Dell regarding GPL license compliance? If so, it might be helpful if I could get contact information for the relevant Dell personnel.

First support response from Dell is that the open source code used in the N1100 series switches (including UBoot and Linux) is NOT available.

Just saw how much those cost and yeah I'd want the GPL code too if they cost that much. Are they afraid of exploits being developed if the code released or what?

The only reason I have one is that I was able to get it for under 25% of list. AFAIK, that N1100 series are actually the _least_ expensive ONIE switches.

I don't think they're afraid of anything. They just can't be bothered to put forth the little bit of effort needed to comply with the licenses.

What actually happens in the case of a GPL violation that becomes a battle? Who fights it and what does the offending agency have to do when found guilty?

The GPL provides that violation can ultimately result in loss of right to copy, which would be disastrous for a company that depends on GPL code in a product. AFAIK it has never been done. Enforcement has to be done by the copyright holder(s) at their expense.

Normally what has happened is that the defendant in a GPL case eventually agrees to honor their obligations. The most notable case where that didn't happen was the VMware case, which was lost initially and upon appeal due to technicalities of the German legal system.

I have only contributed trivial patches to the Linux kernel, so I wouldn't have standing to sue, even if I could afford to do so. My own request to Dell might not yield the desired results, but if not, perhaps the Linux Foundation might send a request that gets more attention.

I am rather surprised that Dell isn't in compliance. Most medium to large vendors of networking gear using Linux actually do provide the relevant source code packages on their public web sites.
