Enough is enough of the #fake #RussianDossier. Just filed a defamation action against @BuzzFeedNews for publishing the lie filled document on @POTUS @realDonaldTrump and me!

Difficult to overcome the actual malice hurdle set forth by New York Times Co. v. Sullivan, 376 U.S. 254 (1964). Truth defense is yet another hurdle. But, guess what Mr. Cohen: that’s what full & complete discovery is for!

How the hell is publishing a document - even if it contains a false statement - a false statement in and of itself? The document was real. What am I missing?

If you have “actual malice”—actual knowledge of falsity or reckless disregard of falsity, you can be held liable for “re-publishing” someone else’s defamation. But since Buzzfeed didn’t present the dossier as verified fact, I think the defamation case is weak.

Exactly. Since they didn't comment on the veracity of the documents, they'd have to prove Buzzfeed KNEW the statements were false and published it anyway. Considering the legitimate public interest, where's the malice? The mere allegation is of legit public interest.
