“Today, a major precedent was set for the future of a free press. It is a win for one reporter, but most importantly a win for the Constitution and the enduring freedoms it grants us all." --Georgetown Law's Institute for Constitutional Advocacy and Protection (@GeorgetownICAP)

It was a TRO. “I want to emphasize the very limited nature of this ruling,” the judge said from the bench. “I have not determined that the First Amendment was violated here.”

These people should read the Judge’s ruling. Not based on the 1st but on the 5th due process says the judge. The WH is to present to the court next the rules and process the press has to follow or they could lose their WH pass. Acosta may have put his butt in a jam latter on

No precedent was set and the injunction was not granted on 1A grounds. This is embarrassing.

Where can I find in the Constitution the right that states all press members must have free and unfettered access to the President and be allowed to ask him several questions while everyone else tries to get a turn?

The judge didn't rule on 1A claim, Issued injunction based on 5A takings clause. If the govt gives you something of value (in this case a hard pass) then it needs to follow due process to take it away. Nothing about free press.

Interesting. I suppose the White House can allow passes to remain but simply cancel press conferences altogether.

If @cnn were smart, having established the principal, they would fire @Acosta and replace him with someone who isn't a grandstanding baffoon. They won't though because, ultimately, they're an organization dedicated as much to grandstanding baffoonery as journalism.

This seems embarrassing for Georgetown ICAP - for two reasons: 1) The court didn't set precedent here and nor did it rule on the matter at all. It issued a TRO until the court decides. 2) If the court did side with CNN, that would be nothing to celebrate. That's bad case law.

Seriously how is it a win for the Constitution for @Acosta to have a press pass? How is it not against the Constitution for anyone else to not have one? I understand (maybe) if CNN was being barred, but only 1 reporter's pass was taken..
