      The implications of broadening the range of people who can have a GRC and therefore take up rights legally defined as protected by sex, which prima facie has implications for those currently enjoying those rights.

      The GRC doesn't convey any sex based rights, the Equality Act of 2010 does. It seems like you have issue with EA2010?

      Is the argument then that the only new right a GRC makes available is a new birth certificate, and that that won't give the holder access to any sex-based rights they didn't have before?

      Leads to back to an earlier question - when the statement's made that rights are being denied, what rights are meant? Just the right to quicker access under law to a birth cert, or more than that, and legal ones or other types?

      The only thing up for debate by government is the GRA - as in the photo. People against the GRA are confusing it with the Equal Rights Act 2010 which states that trans people can use the facilities of their (chosen) sex. ie: trans women are women and can use the ladies loo..../1

      2/... Some same sex spaces *may* exclude trans people but this must be legally assessed one a case-by-case basis. The anti-trans activists believe that making it easier to get a GRC will mean that any cis man will be able to claim they are trans to gain access to ....

      3/ .... female spaces for illegal/abusive reasons just be *claiming* they are a woman that day. The reality is: they could do that today yet there hasn't been a single case of anyone doing so. Changes to the GRA in Ireland makes it clear that anyone making a false declaration..

          It's not just about single-sex spaces. Holders of a GRC count as "new" sex for statistical purposes, to access measures designed to redress sexual inequality, etc. Also not just about the law as lots of orgs e.g. Labour are acting "before" the law (i.e. illegally) now.

          It's not illegal as there is no law that says they can't. Each instance where it *may* be appropriate to exclude trans people must be taken on a case-by-case basis. They've obviously decided that it is not appropriate to exclude them. It's their right to do so.

          I think it will turn out to be illegal - because AWS by self-ID excludes people on the basis of their beliefs, which is not a legal use of the exceptions in the EA. But I guess we need to wait for the court case.

          My guess regarding AWS? It'll be left up to each party to decide for themselves. A solution that helps no one but means no one has to give a definitive answer. But yes. We will just have to wait.

          That would be very interesting - feels unlikely to me though. If your sex is determined by the rules of the organisation you're engaging with, surely nobody is protected by the EA?

          Some local definitions look much less legally justifiable than others. Spaces - only problem probably if you're advertising them as single-sex but they're actually open to anyone. Or if putting staff in position of deciding who's "really" trans. AWS - can't see how self-ID legal.

          Although thinking about it, maybe self-ID for ostensibly women-only spaces has same issue as for AWS, in that a man could say "you're excluding me on the basis of my beliefs". But unisex spaces would be legal.
