The tell in nascent Republican attacks against HR1 is the unsupported claim that the legislation is unconstitutional. It’s a signal to loyalists on the bench, and why Dems need to move fast, and at least brandish the threat of expanding the courts.https://twitter.com/Mike_Pence/status/1367088000602157061 …

They haven’t made up whatever argument they’re going to use, or Pence would’ve included some specific claim. But they don’t care. They just want it enjoined nationally en route to a 6-3 or 5-4 ruling gutting the law before it can balance the scales for a single election.

That would be constitutional. Making it harder for Black people to have the right to vote is unconstitutional, which is why SCOTUS had to make up reasons to gut the VRA and will do so again.

The Alito six are going to have a difficult time with Article One Section 4 Clause 1, at least w/r/t elections for representatives and senators. It clearly empowers Congress to supersede state laws.

What do Republicans think the original Voting Rights Act, 14th, and 15th Amendments are? One day someone will explain to me how this isn’t the biggest story in the entire country or why @Sen_JoeManchin and @SenatorSinema don’t want to abolish the filibuster to combat thispic.twitter.com/Ty5DvoyTAa

Plenty of actual reasons to be concerned with several aspects of this bill. Take ballot harvesting.https://www.nccivitas.org/2020/confessions-election-fraud-master-vulnerable-nc-voters/ …

You say they need to move fast but how would you propose they do that with Manchin and Sinema blocking the elimination of the filibuster? What do you think of Norm Ormstein’s proposals here?https://www.washingtonpost.com/outlook/2021/03/02/manchin-filibuster-never-sinema/?outputType=amp …

I see your reply-to includes Ian Millhiser, I guess because he retweeted the original one. I can assure you he agrees with these proposals, and even has a couple additional options!https://www.vox.com/22260164/filibuster-senate-fix-reform-joe-manchin-kyrsten-sinema-cloture-mitch-mcconnell …
