Brian, you can't be suggesting that the three-fifths clause isn't sacrosanct! Why, it's in that divinely inspired document, the Constitution, along with the electoral college!
BTW, the way the electoral college votes was changed by the 12rh amendment in 1804 after experience showed the original system didn't work so good anymore with the emergence of political parties. But hey, it can't be changed now, that would be wrong.
He can argue for himself, but I think Dan is saying that the historical record has been a generally successful one. But I think there’s no particular reason to think that just electing the person who gets the most votes wouldn’t have turned out fine, too. (Although I think a
runoff is a good idea—a president elected by a majority of the voters has more democratic legitimation. By contrast, one who doesn’t even win a plurality has no legitimation in any modern understanding of democracy.
The Electoral College we have now isn't even the one devised by the Founders.
The argument is fallacious in countless ways.
