We should expand on this to require the Commissioner to automatically publish the returns of both candidates and incumbents. Thus, disclosure would be a consequence of running rather than a potentially unconstitutional prerequisite.

If there is a constitutional limit on requiring release of tax returns absent compulsory process like a subpoena, a statute would not cure it. Presumably the constitutional infirmity lies within the right to privacy, so the subpoena is the right limit on that right.

The constitutional issue concerns qualifications for office, not privacy. Qualifications are set in Constitution. Automatic tax data release, performed by someone other than officeholder, is better than requiring release *by* candidates or office holders.
